The federal government introduced the legislation, to address the impact of a High Court decision that ruled that indefinite detention was illegal, and resulted in the release of hundreds of immigration detainees.

The High Court of Australia on November 8 ruled to abolish indefinite detention and free 148 immigration detainees, including at least three convicted murders and several perpetrators of sexual crimes. One of them is the case of convicted perpetrators of sexual crimes of Myanmar origin.

Following the High Court decision, the Labour Party rushed to pass emergency legislation, imposing curfews on those released and forcing them to wear tracker bracelets.

The federal cabinet has met to issue more amendments aimed at further strengthening the legislation.
