Brazilian national facing 16 revenge porn charges arrested in Sydney

Accused of filming himself having sex with his ex-boyfriend and posting the images on a porn site, Sydney-based Fabricio da Silva Claudino has now been arrested on new charges including of masturbating near a high school in Sydney. "Threat to the community," said the judge.


At a hearing last Friday (February 21), magistrate Robert Williams denied bail, saying that Brazilian Fabricio da Silva Claudino, 31, represents "a serious risk to the community" and "a threat to the safety of his victims".

Former Emirates flight attendant Fabricio reportedly recorded him and his boyfriend having sex and posted the videos without his boyfriend's consent on OnlyFans, a website where subscribers pay amateur porn stars to post explicit content.

Fabricio Claudino da Silva arrived in Australia in July 2019 and was arrested in September of the same year accused of revenge pornography. He was on bail when the police arrested him last Friday on his house in Surry Hills. 

"He used his cell phone to film his victim at the time when the victim is most vulnerable, during sexual intercourse," said prosecutor Chris Manning.

According to the ABC, Manning argued in court that the Brazilian would certainly continue to record videos and repeat the crime if bail was maintained, "since this is the only way for him to support himself in Australia".

In making the arrest at his home in Surry Hills last Friday, the prosecutor alleged that Fabricio, an amateur porn video star and Instagram influencer with more than 30,000 followers, committed other serious offenses.

"He took his penis out of his pants and started masturbating ... and he did it in front of Central Sydney High School, said Manning." He is a person unable to control his desires, "he added.

Fabricio's defence lawyer, Jessica Tohi, argued that any risk to the community could be mitigated with strict bail conditions, including banning access to social media and just being allowed to use a cell phone.

"He is not in trouble because he posted these images on forums ... the problem is that they appear to have been taken in public places," said his lawyer.

"There is no evidence that anyone saw him taking these photos or recording these videos."

But magistrate Robert Williams said that the new charges were "solidly based " and that the defendant could face up to five years in prison if found guilty.

According to court documents, Fabrício allegedly exposed himself on several occasions in or around his apartment on Chalmers Street in Surry Hills, including on a staircase in the building and on a bus.

The documents also detail allegations of offensive behaviour on a train platform at Sydney Central Station.

Outside the courtroom, her friend Elisa declined to comment on the case, and her lawyer Jessica Tohi said her client was "doing as well as possible" while being held in a cell at the Sydney Police Center in Surry Hills.

The case returns to the Central Local Court on February 26.

According to the Sydney Morning Herald, Fabricio posted on his Instagram account photos of his walks through Kangaroo Valley, Bondi Beach and Mollymook. He had 30,000 followers.

"I didn't know what to think, I couldn't believe it," says boyfriend

Fabricio's then Australian boyfriend gave ABC an interview and said he was in shock.

Lachlan *, who is not his real name, told the ABC that he "didn't know what to think, couldn't believe it" when he recognized himself in the video.

"I felt a pain in my stomach when I recognized my body and then my face," he told ABC.

Lachlan's face is not visible in the video, but his tattoos are, as is a photo of the couple.

Lachlan said the two met on Ipanema beach in Rio de Janeiro.

"Fabricio was charming, charismatic and lively - he was spontaneous and popular - and he took me to various places, introduced me to his friends," said Lachlan.

Lachlan said he agreed to pay for a one-way ticket for Fabricio to come and live with him in Sydney.

Fabricio came to Australia, however, two months later, Lachlan says he discovered the videos on the OnlyFans website.

Fabricio went to visit a friend in Melbourne where he stayed for two weeks, when Lachlan reported the alleged breach of privacy and revenge porn to the Surry Hills police.

When the Brazilian returned to Sydney, he was arrested by Australian Federal Police officers and spent the first night behind bars.

Fabricio pleaded not guilty to the charges and was released on bail, but ended up being arrested again last Friday, February 21, accused of 16 crimes.

A GoFundMe page 'Free Fabricio' was created with the aim of raising AU $ 8,000 in legal fees for a bail request, but until the publication of this article no money had been donated.
