Don’t fear deportation: Experts urge temporary visa holders facing domestic violence to seek support

In this podcast, SBS Hindi discusses the impact of domestic violence on temporary visa holders in Australia, including available support and essential first steps. We spoke with experts, including Nelly Sinha from NSW Police, lawyer Anita Soni Pershad, and legal professional Carl Buhariwala, host of the YouTube channel @beinformed.


According to the information received from the Department of Home Affairs, the Australian Government has a strict zero-tolerance policy towards domestic and family violence (DFV), protecting everyone, including both permanent and temporary visa holders. Other key highlights are:
  • As of December 6, there were over 2.7 million temporary visa holders in Australia.
  • The Migration Regulations 1994 contain Family Violence Provisions (FVPs) which allow certain visa applicants to be granted a permanent visa if their relationship has broken down and they have experienced DFV perpetrated by the sponsoring partner or primary applicant.
  • On average, around 780 primary Partner visa applicants seek access to the FVPs each year (based on the previous five years, 2019-20 to 2023-24).
  • The Government allocated $8.9 million in the 2023-24 Budget to expand access to the FVPs to most permanent visa subclasses and additional cohorts of Partner visa applicants.
